- Abstract
This article focuses on the court ruling in the case of Hall v. Allied Mutual Insurance Co. Where claimants who were residents of Iowa were killed by an uninsured motorist in Oklahoma, wrongful death law of Oklahoma rather than that of Iowa governs the amount of damages collectible under uninsured motorist endorsement. The court decided that the law of state in which jurisdiction would have been obtained over tortfeasors had they been insured rather than the state where the policy was issued applied. Under Iowa law the measure of damages in a death action is the present worth or value of the estate decedent would be expected to accumulate in a natural life time.
