- Abstract
The article focuses on the decision of the New York Supreme Court, given in the year 1966, in the lawsuit "Pagan v. MVAIC." The court decided that a claimant who had just alighted from stalled automobile and was standing in front of vehicle manipulating battery cables at the time automobile was struck by second automobile, was "occupying" his driver's automobile within uninsured motorist endorsement which defined "occupying" as in or upon or entering into or alighting from.
