The article examines the issue of questionable patents cited by the U.S. Federal Trade Commission (FTC) and looks at the problem of patents that are obvious in view of preexisting material. Topics discussed include the economic underpinnings of the Patent System; the patent requirement of nonobviousness; and use of signal theory to determine nonobviousness of intentions when a declaration is submitted.
