- Title
Insolvency Filing Period Extended by Failure to Receive Notice.
- Authors
Darr, Frank P.
- Abstract
The article focuses on the decision of the New York Supreme Court on the case involving the failure of the state liquidator to notify an insured party of impending cancellation. As part of the liquidation proceedings, the liquidator had notified policyholders that policies may be cancelled. However, the court concluded that cancellation notice does not disrupt the policyholder's existing right to notice. Moreover, the court asserted that the liquidation process must be more flexible than that suggested by the state.
