- Abstract
The article discusses U.S. legal cases and developments in marketing relative to the regulation of unfair competition. In reference to advertising the United States v. Golden Fifty Pharmaceutical Co., Inc. and Michael Posen and the Beneficial Corp. and Beneficial Management Corp. v. Federal Trade Commission cases are cited. In 1976 a major criteria in determining the existence of deception or unfairness in advertising was the tendency to cause "unreasonable risk or harm." In 1976 the U.S. Federal Trade Commission (FTC) established a rule which would require certain companies to provide foreign-language translations for financing documents, particularly where credit contracts are involved in the sale.
