- Abstract
The article argues that the decision in the case United States v. Ponds is correct. It states that the court focused too much on the prior knowledge of the government and too little on the actual testimonial character of the production itself. The article suggests an alternative understanding of the testimonial nature inherent in the act of product that threatens to limit the use of subpoenas strictly against those that are the targets of prosecution.
