The article focuses on the U.S. Court of Appeals for Ninth Circuit in the case Multi Time Machine v. Amazon on the multifactor tests for likelihood of confusion and trademark infringement. It mentions that multifactor infringement tests remain effective for analyzing confusion and competition on the Internet. It also mentions that business model of Amazon which creates negative externalities for competitors and consumers.
