TRIAL BY JURY: A CRAP SHOOT OR A WELL REASONED FACTUAL DETERMINATION--IT ALL DEPENDS ON YOU.
- Authors
Brown, Michael J.
- Abstract
The article presents principles for trial judges to adhere to when dealing with juries in the U.S. It is the job of a trial judge to see to it that the jury get access to all the facts admissible under the law and to instruct them as to the applicable law. During the pre-selection of jury, the trial judge is advised to give short opening statements regarding the facts each party intends to prove. During breaks in the trial, the jurors should be allowed to discuss the case, specifically the evidence, the witnesses and the exhibits.
