- Abstract
The article discusses the issue of what constitutes a public use for purposes of eminent domain authority in promoting the development of state natural resources with respect to the case of Kelo versus the City of London. The U.S. Supreme Court held that the City of London's use of eminent domain for economic development purposes was in fact a public use and was constitutional. A historical overview of the constitutional and statutory authority for natural resource development takings regarding the role of eminent domain is also included.
