- Title
Interpretation of s. 80 of PACE 1984: When Is a Spouse Compellable?
- Authors
Stockdale, Michael; Wortley, Natalie
- Abstract
The article discusses a court case wherein it was ruled that a wife, who is a victim of domestic violence, was not compelled to give evidence against her husband. In R v A (B), the prosecution argued that the husband was compellable under s.80(2A)(b) of the Police and Criminal Evidence Act 1984. It was ruled that the husband was not compellable because the offence did not involve an assault, injury or threat of injury.
