- Abstract
The present essay analyses the development of the right to be forgotten starting from paradigmatic judgments, foreigners and nationals in kind, especially, on the recognition of the called right to be deindexed. Adopting as our underlying theme the jurisprudence in what concerns Lebach's case, which took place in Germany, as well as Mario Costeja González v. Google, which occued in Spain, we seek to analyse critically how has been developed the brazilian jurisprudence regarding the right to be forgotten, through the understanding that was established by the Brazilian Court in the matter of the Aída Curi's case, along with it's revisions and limitations. Concerning the method, this research is qualitative, comprehensive and critical-reflexive in nature, adopting academic sources such as jurisprudence, with emphasis for the Brazilian Suprme Court of Justice's decisions related to the right to be forgotten. As theoretical framework, were adopted a serie of doctrinial reflexions, especially, the opinion of Jorge Manrique, Stefano Rodotà and Francisco Javier Leturia Infant. In conclusion, it is shown how the brazilian jurisprudence has not still absorbed completely the right to be forgotten. Despite the fact that the brazilian jurisprudence has already approved the tecnical strategy of the deindexation, has not still progressed in what concerns the material dimension, that is, on the clarification of the contents which can limit viewers. Overcoming this challenge may be the brazilian contribution to the international development regarding a new perspective to the controversy of the right to be forgotten.
