- Title
The Principle of Substantial Conformity of Sentences Revisited.
- Authors
Mendonça, Augustine
- Abstract
The article examines the doctrine of substantial conformity of sentences. It points out that the doctrine of conformity between two sentences or decisions is directly associated with the institute of res iudicata which, according to the canon 1641, occurs if a second concordant sentence is rendered between the same parties over the same issue and on the same cause for petitioning. Also explored is the jurisprudence on the principle. The background and arguments raised in a marriage nullity case judged affirmatively at the Rota were cited.
