- Abstract
Si riporta il caso di un operatore socio-sanitario con diagnosi di 'infezione da HIV, gruppo C3' e di 'disturbo della personalità in fase di scompenso' giunto all'osservazione del medico competente in occasione della visita precedente alla ripresa del lavoro (a seguito di assenza per motivi di salute di durata superiore ai 60 giorni continuativi) ex art. 41 c. 2 lett. e-ter) del D.Lgs. 81/08. Viene posto in evidenza il delicato compito del medico competente che - in occasione della valutazione dell'idoneità del lavoratore alla mansione specifica - deve contemperare due fondamentali esigenze: la tutela dell'operatore socio-sanitario affetto da HIV (ex L. 135 del 5 giugno 1990) e la sicurezza dei portatori di handicap psicofisico oggetto dell'assistenza nel momento in cui non è più garantita la salute psichica.
