- Abstract
The article argues that the benign neglect standard of the Americans with Disabilities Act should be used when municipalities are sued for law enforcement's use of violent or deadly force against a person with mental illness or emotional disturbance. Topics discussed include law enforcement officers' inability to handle mental health emergencies, civil deprivation of rights cause of action under Title 42 of the U.S. Code, and standard of deliberate indifference.
