The article discusses the legal question of whether paid administrative leave can be considered an adverse action that gives rise to a First Amendment employment retaliation claim. It explores the different circuits have held conflicting views on this issue. It mentions the Eleventh Circuit had the chance to weigh in on this issue, but declined to adopt a broad or clear rule on whether paid leave always constitutes an adverse action for the purposes of a First Amendment retaliation claim.
