- Abstract
The article offers information on the judicial decision of the Seventh Circuit of the U.S. Court of Appeals in Whitlock v. Brueggemann, in which the Court addressed the split regarding a prosecutor's immunity from the civil liability claims under the Section 1983 of Title 42 of the U.S. Code. Topics discussed include the Ku Klux Klan Act of 1871, analysis of the Marbury v. Madison opinion, and the doctrine of the Brady v. Maryland.
