- Abstract
Kyrgyz people who adopted a sedentary life in the beginning, after Chinqis Khan's domination in 1212 and Russian occupation in 1865 sought its freedom and therefore retreated to mountainous countryside of strategical importance. Although they have been Muslims for centuries, the life of the Kyrgyz, unlike other Turkic clans, as part of nomadism prevalent in rural and mountainous areas, was at its every stage predicated on customary law rather than Shariah law. Dealing with the customary practices of the Kyrgyz regarding betrothal in terms of Islamic Law, this study endeavours to determine the place of each related matter in fiqh (Islamic Jurisprudence). Discussing in detail the topic of betrothal as the point where customary law and religious law intersect, the paper attained some important findings and conclusions in the light of invaluable works. Especially, under the themes like “The Engagement in Kyrgyz Customs and Retribution For The Canceling”, “The Engagement in İslamic Law and The Consequences It’s Breaking”, “The Recompense of Marriage of an Engaged Girl to Another in Kyrgyz Customs and Islamic Law”, “The Contempt for Lack of Virginity in Kyrgyz Customs and Islamic Fiqh”, “The Death One of Partners in The Period of Engagement And Brother or Sister Substitute”, “The Analysing on the Betrothed in the Cradle from the Perspective Kyrgyz Custom Law and Islamic law”.
