Class Action Waivers: Recent Developments.
Abstract
This article discusses several U.S. court cases in which class action waivers were involved. An Alabama federal court held that it is up to the arbitrator to deem a class arbitration permissible under the agreement of two parties. An Arkansas court decided to enforce the clause that bars classwide proceedings, in a claim against a wireless provider. The Wisconsin Court of Appeals decided that a waiver of class arbitration is enough to deem a consumer arbitration agreement as unconscionable.
