THE PLACE FOR ILLUSIONS: DEEPFAKE TECHNOLOGY AND THE CHALLENGES OF REGULATING UNREALITY.
- Authors
Joost, Lindsey
- Abstract
Existing laws are insufficient to address the harms caused by deepfakes. This Note explores the characteristics of deepfakes that make preventing both the misuse of the technology and its proliferation on social media and the Internet difficult. This Note will then continue by explaining the special potential harms that deepfakes pose. The third part of this Note will address how the existing legal framework fails, includinghow Section 230 of the Communications Decency Act serves as a barrier to redress. Finally, this Note suggests potential remedies for deepfake transgressions to reduce the potential harm that deepfakes can inflict.
