- Abstract
The article discusses the court case K.L.S. v. Union Pacific Railroad which deals with the duty of care and liability of a property owner for assault near its property. The Jackson County Circuit Court granted a summary judgment in favor of Union Pacific, the plaintiff appealed the trial court's decision, and the Missouri Court of Appeals ruled that Union Pacific is not liable for assault which happened neither on nor adjacent to any property it owned.
