- Title
THE PROBLEM OF QUALIFIED IMMUNITY IN K-12 SCHOOLS.
- Authors
Smith, Sarah
- Abstract
The article focuses on doctrine of qualified immunity and policy justifications and summarizes protections for school officials to defend against Section 1983 claims. It mentions application of qualified immunity is inappropriate in the K-12 public school context because it fails to support the Supreme Court's policy justifications for the doctrine. It also mentions Fourteenth Amendment excessive punishment claims, and explains how First Amendment claims for violations of student speech.
