- Abstract
The article discusses a court case, Zurich American Insurance Co. v. O'Hara, wherein Keith O'Hara was a beneficiary under the Zurich medical plan from where he got money for his injuries. Court observed that O'Hara recovered some amount from the third party and thus Zurich wants to collects the benefits of reimbursement and subrogation provisions under the federal common law "Make-Whole Doctrine". The court reviewed that O'Hara has to reimburse Zurich.
