- Abstract
The article discusses the allocation and legal protection approach for the basic property rights of a community in the context of land use exactions in the U.S. The community in which the land is located has limited rights to promulgating regulations that protect the public from the implications of the proposed land use development. There are several factors and issues landowners must consider in the process of community bargaining for land development. The restraints on alienation of entitlements for community land use are analyzed. The kind of entitlements the community must posses and how they can be protected by these entitlements are also discussed.
