- Abstract
The article discusses the role of probative statistics in employment discrimination cases. The set of possible probative parity studies in reading discrimination cases are the protected group employees expressed as the percentage of employers' total work force, work force at a particular level, recent hires to whole firm, recent hires, assignments or promotions to particular level, type or division, and hire or promotion candidates. The criteria for judging the significance of parity are the rule of exclusion, overwhelming or gross disparity, arbitrary difference, univariate significance and multivariate tests. Potential problems with regression analyses include the underestimation of the effects of discrimination, measurement error, and omission of crucial variables such as productivity.
