- Abstract
The article discusses the use of injunctions against divorce proceedings outside the domicile and declaratory judgments in migratory divorce. With an understanding of injunctions against divorce proceedings outside the domicile, the jurisdiction of the equity courts to grant divorce became established in England and the U.S. The earliest function of the declaratory judgment both in Roman law and by specific designation in the English law, was the determination of questions of status. The author takes for instance several previous migratory divorce cases which have used declaratory judgments.
