- Authors
NAIBERG, RICHARD
- Abstract
The article offers information regarding the resolution of high stakes patent disputes in Canada. It mentions that the Federal Court of Canada has adopted alternative dispute resolution (ADR) mechanisms to encourage access to justice and discourage litigants from using alternative jurisdictions. It emphasized that an arbitrator must apply the law as it exists, and also reflects the significance of pre-trial conference that is held once discovery is complete and parties become ready for trial.
