- Abstract
Objective: The main objective of this work is the problem underlying the identification of ways to guarantee the efficiency of civil liability in Maritime Law, involving autonomous vessels, aiming at greater legal security, considering the theory of risk. As well as to analyze the possibility of assigning judicial personality to the ship, as a way of guaranteeing the efficiency of the civil liability. Methodology: through a scientific synthesis, this article uses the deductive research method, through bibliographic and documentary exploration, based on the analysis of references of articles, relevant bibliographic studies, legislation and jurisprudence on the subject. Results: considering the various legal relations that develop around the ship, legislation should establish ways of ensuring national legal certainty through efficient civil liability. Therefore, one of the objectives of defending the judicial personality of the autonomous ship is to ratify its responsibility, that is, that the ship can be liable to indemnify obligations and can even be party to a judicial process, including avoiding exemption of liability before the specific case. Contributions: the present study brings as a contribution the discussion about the need for the realization of civil liability involving autonomous ships, including in cases of maritime accidents, which are even increasing, since, in 2017, accidents with boats in Brazil increased 12.63%.
