- Abstract
The article focuses on the right of reply on the Internet, the efforts of the Council of Europe (CoE) and the European Parliament to bring a unified position on an online right of reply, and problems presented by the First Amendment in enacting an online right of reply statute in the U.S. It discusses developments related to the right of reply in Europe including the recommendations on the Right of Reply in the New Media Environment, adopted by the CoE Committee of Ministers in 2004, and a recommendation on the right of reply online, adopted by the European Parliament. It also discusses the Section 230 of the U.S. Communications Decency Act which provides immunity to Internet service providers (ISPs) and website operators from liability for defamatory statements posted by third parties.
