- Abstract
The article analyzes the difference between two statutory provisions "laid-off" and "discharged" under the Wage Payment and Collection Act (WPCA) of West Virginia. It discusses the judicial decision of the Supreme Court of Appeals of West Virginia in the case of Lehman v. United Bank Inc., in which the the Court addressed the definitions of discharge and layoff as defined in legislative rules by the West Virginia Division of Labor.
