- Abstract
The article discusses how American courts should handle requests for discovery of nonparty medical records as of 2018, and it mentions confidentiality and privacy concerns, litigants' due process rights, and America's Federal Rules of Civil Procedure. The impact of the U.S. Health Insurance Portability and Accountability Act of 1996 on discovery is examined, along with the claim that discovery of nonparty medical records should only be allowed upon a showing of good cause.
