- Abstract
Legal professional privilege (LPP) enjoys a sometimes widely divergent level of protection in Europe. The ECJ has therefore prescribed a minimum standard in a tax law decision and for the first time included the LPP not only under the right to a fair trial under Art. 42 of the Charter of Fundamental Rights of the European Union (Charter), but also under respect for private life under Art. 7 of the Charter. This extends the scope of protection of the LPP to mere advisory activities that do not have to be related to a concrete (criminal) case. Regarding European competition law, this has implications for dawn raids by the European Commission, requests for information regarding merger proceedings and information claims in civil antitrust damages actions.
