- Abstract
The article analyses the legal treatment of due obedience in the National Court of Appeals for Criminal Correctional Matters of the Federal Capital during a key stage of the last transition to democracy in Argentina, the period between the end of the Trial of the Juntas and the Full Stop Law. In the sentence of the trial of the former commanders, the Buenos Aires Court of Appeals ordered the continuation of the investigation of military officers of different ranks in the structure of the Armed and Security Forces. In this context, hundreds of files held by the Supreme Council of the Armed Forces began to be appealed in federal chambers throughout the country, and the issue of due obedience became central to the public and legal debate. Based on an examination of various judicial sources, the article deals with two cases in which the Chamber ruled on the scope and limits of this notion, the "Camps" and “Hagelin/Astiz” cases. Among the conclusions, the article shows the leading role that the Chamber played in the months following the Trial of the Juntas and the impact that its rulings had on the dynamics of that moment of the transition.
