- Abstract
The article provides a brief history of the development of the modern bilateral investment treaties (BIT) in the European Union (EU). It describes the changes concerning foreign direct investment (FDI) introduced by the Lisbon Treaty. It examines the problems arise due to the changes and it proposes the implementation of interim measures to facilitate the transition from a system of Member States mixed competence to a system of EU exclusive competence.
