- Abstract
In this article, the author offers insights on the methodology used in the free speech theory in the U.S. She focuses on disagreement on how to approach the theory and how professors James Weinstein and Robert Post establish their democracy-centered approach defenses. He notes that their account has difficulty in justifying a direct free speech protection. He explains the functions of the theory such as in providing theoretical basis in understanding practices and free speech protection.
