The article presents information on the vacatur of probate decree in New York related to administration of estates. The standards that are applied by the courts while denying and granting vacatur, pre-vacatur disclosure and evidentiary hearings are discussed. The concept of in terrorem clause, waiver of vacatur and consent and countervailing policy interests are also discussed.
