- Abstract
The article offers an overview on the case of Metalclad Corp., Methanex Corp. and Glamis Gold Ltd. in the U.S. It mentions the Article 1110 of the North American Free Trade Agreement (NAFTA) which grants private investors the right to compensation for government measures that effectively deprive investments. It also notes that the Chapter 11 arbitration of Metalclad and Article 1110 form a primary derogation of state sovereignty.
