- Abstract
In the case of "New York State Conference of Blue Cross & Blue Shield Plans v. Travelers Insurance Co.," the U.S. Supreme Court overturned a Third Circuit Court of Appeals decision by holding that surcharges imposed on hospital bills by the State of New York do not relate to employee benefit plans within the meaning of ERISA Section 514(a) and therefore are not preempted. The question decided by the U.S. Supreme Court in this case was whether ERISA preempts a New York state law imposing surcharges on bills of patients whose commercial insurance is purchased by employee health care plans governed by ERISA, and for surcharges on HMO insofar as their membership fees are paid by an ERISA plan.
