- Abstract
The article examine legal doctrines that enable Catholic institutions in the U.S. to discriminate against LGBTQ employees and urges these institutions to adopt an equitable policy modeled after the Catholic Church in Germany. It mentions gaps in non-discrimination laws covering sexual orientation and gender identity and the First Amendment ministerial exception that protects religious institutions from employment discrimination claims.
