- Abstract
The article discusses the court case Schrems v. Data Protection Commissioner wherein the Court of Justice of the European Union (EU) declared invalid the Commission Decision 2000/520 through which the Safe Harbour Scheme that legitimizes data flows between the EU and the U.S. was adopted. The case originates from a complaint regarding the transfer of personal data of users of Facebook Ireland Ltd. to the U.S. The changes needed to the EU data protection's legal framework are suggested.
