- Abstract
The article focuses on the rule of law in the construction industry that has not experienced the growth that has occurred in other areas of law in the U.S. It notes that while construction cases should be resolved by judges, disputes are sent to mediation, and other forms of alternate dispute resolution (ADR). It further emphasizes the need for courts to continue providing the legal framework that will in turn contribute to the settlement of disputes by setting standards and rules.
