- Title
A PRIMER ON GROUNDWATER LAW.
- Authors
DELLAPENNA, JOSEPH W.
- Abstract
The article discusses the concerns related to groundwater law for allocation of groundwater in Arizona. It addresses five theories for allocating groundwater including appropriative rights, regulated riparianism, and absolute ownership. The correlative rights and reasonable use rule both require a sharing of the groundwater resources among them who have legitimate claims and the rule of capture indicates that water user has no property in the groundwater until the water is pumped from a well.
