- Abstract
The article focuses on the clear statement rules and executive war powers of the president of the United States in relation to various court cases. In the case of Ali Saleh Kahlah al-Marri, statutory authority was a central issue wherein the Bush Administration designated al-Marri as an enemy combatant and was moved to military custody. In the case of Hamdan v. Rumsfeld, the Court decided not to allow the Bush Administration's military commission system.
