- Title
LG Köln: Verpflichtung von Meta zur Zahlung an die Deutsche Telekom.
- Authors
Pfeiffer, Jan
- Abstract
The Higher Regional Court of Cologne has ruled that a website for terminating a supply contract is inadmissible if the confirmation page is divided into several independent web pages. The termination button must directly lead the consumer to a confirmation page that contains all necessary information and is clearly labeled with the words "cancel now". The Federal Constitutional Court has rejected an urgent application by the Marxist-Leninist Party of Germany (MLPD) to broadcast a campaign advertisement on radio that included commercial advertising for a book. The court ruled that the objection did not concern the content of the book, but rather the presentation of a commercially distributed book. The Regional Court of Cologne has granted a lawsuit by Deutsche Telekom AG against a subsidiary of the Meta Group. It concerned a compensation of 20 million euros for data transport services. The court ruled that Meta could not continue to use the service after terminating the contract. However, it did not see any abuse of Telekom's dominant market position. Telekom considers the verdict as evidence of a regulatory problem that needs to be solved.
