- Abstract
The Law 78/2008 created the general frame of the National System of Genetically Judicial Dates, in order to help investigations of the most violent crimes. This system needs to be improved and the judicial practice is capable to offer some new solutions. Prosecutors should have the right to ask to the court, the order to collect the biological materials, from persons, even without their consent. We propose also to collect the biological materials before executing penal decision (before going to prison and not after) and also from minors less than 14 years, if they committed violent crimes, even without their parents consent. There is no reason to omit from collecting biological material, persons convicted to a life sentence or prison under suspension. The biological materials should be preserved by the administrator, at least 15 years after death of a convicted person and without age limits for the living persons.
