- Abstract
The article "10 Years of Short Selling Regulation" discusses the introduction of the short selling regulation as a response to the 2008 financial crisis. The regulation includes various aspects such as transparency obligations, the prohibition of uncovered short sales, and supervisory powers. Short sales are generally economically harmless but can be used for market manipulation in exceptional situations. The European Securities and Markets Authority (ESMA) has proposed adjustments to the regulation to ensure financial market stability. It is being examined whether the regulation has achieved its objectives and whether the ESMA's proposals can contribute to this. There are still uncertainties regarding supervisory powers, and there is a discussion about whether civil liability for violations of the market manipulation prohibition is appropriate.
