- Abstract
Possible maritime risks in maritime trade lead to heavy responsibilities for the shipowners. Shipowners can insure their responsibilities against the dangers they may encounter at sea, thanks to the insurance system. Marine insurance, which is one of the first examples of insurance types, is a type of insurance that has developed until today as a result of the practices of countries that have been pioneers in maritime trade since ancient times. Regulations in Turkey are mainly under the influence of western law. The main types of marine insurance applied today are hull insurance, cargo insurance, club insurance and compulsory liability insurance. While marine insurance was specifically regulated in the old Turkish Commercial Code (1956), it is seen that this issue was regulated as a type of insurance subject to general rules in the new Turkish Commercial Code (2011). Such an regulation also brings some problems in terms of marine insurance. Putting forward the problems and seeking solutions are the subject of the study.
