- Title
SUPPLANTING FOREIGN ANTITRUST.
- Authors
MICHAELS, RALF
- Abstract
The article discusses a question about why American antitrust law should supplant a foreign country's own determination of how to best protect customers from anti-competitive conduct by foreign companies in places such as Canada, Great Britain, or Japan. The U.S. Supreme Court's ruling in the 2004 class action case F. Hoffman-La Roche Ltd. v. Empagran SA is examined, along with antitrust laws in developing countries and the legal aspects of multinational cartels.
