- Abstract
This article discusses a case involving a motion to disqualify arbitrators prior to the arbitral award. Where arbitrators have been involved in the transaction disinterested to the matter or the dispute at hand, the court still has the power to disqualify them and appoint substitute arbitrators in accordance with New York Civil Practice Law Rules 7504. The court distinguished this case from Matter of Glatzer (Diamond), 19 Misc.2d 77 afFd. 9 A.D.2d 675 where the arbitrators were long time associates and friends of all parties to the arbitration.
