TIMELY CHALLENGE OF A DISCHARGE, NAMELY, WITHIN FIVE WORKING DAYS AFTER NOTIFICATION OF DISCHARGE, IS A PROCEDURAL ISSUE, SINCE ONLY TIMELY NOTIFICATION WOULD HAVE MADE THE DISPUTE ARBITRABLE.
- Abstract
This article focuses on the court ruling given in Amal, Meat Cutters and Butcher Workmen of North America, Local 195, AFL-CIO v. Way case. Timely challenge of a discharge, namely, within five working days after notification of discharge, is a procedural issue, since only timely notification would have made the dispute arbitrable. Determination of this issue remains solely with the arbitrator and a motion of the union to compel arbitration was therefore granted.
