- Abstract
Is there a legislated anti-discrimination law that protects LGBTQIA+ people in Brazil today? Through the collection of statutory norms, especially legislative ones, crossing all spheres of the federation, as well as interdisciplinary theoretical research, the article demonstrates that yes, that this right exists and that it has an important legislative dimension. From the outlines of this map of laws, three dimensions are analyzed: enforceability, in dialogue with contemporary reflection on the fundamental rights character of LGBTQIA+ rights; interdependence, dimension of fundamental rights, explored to reconnect LGBTQIA+ anti-discrimination legislation in multiple dimensions and as a normative body; and, finally, social progressivity and prohibition of retrogression, as a key legal direction in the face of potential legislative attacks on these rights.
